INTRODUCTION

Alyst Dating, Inc. is a corporation governed by the laws of the State of Nevada (throughout this Privacy Policy we will refer to ourselves as the “Company,” ”we," “our,” or “us”). We own the website www.alystdating.com and the associated mobile app Alyst (we will refer to both as the “Platform”)

The privacy and security of your personal information are very important to us. This Privacy Policy describes how we collect, store, use, and disclose personal information (as defined below) of the Platform users.

We aim to limit our collection of personal information to only such personal information as required for legitimate purposes. We do not sell, rent, trade or otherwise disclose your personal information to third parties, other than as described in this Privacy Policy. We take appropriate security measures to protect your personal information and we respect your right to access your personal information or have it corrected or deleted, at your request. If you have any questions, or want to know exactly what personal information we keep about you, please contact us.

We may amend this Privacy Policy from time to time. We will notify you of any such changes in advance. By using the Platform, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and you hereby consent that we will collect, store, use, and disclose your personal information as outlined in this Privacy Policy. If you do not agree to any practices in this Privacy Policy, please stop using the Platform.

PERSONAL INFORMATION

“Personal information,” also known as personal data or personally identifiable information, is any information related to an identifiable person.

WHEN WE COLLECT PERSONAL INFORMATION ABOUT YOU

When registering for an account: When you register for an account on the Platform using your LinkedIn account’s credentials, we will collect the following personal information from you: name, email, and profile photo.
When creating a profile: We will collect any information you provide to us when you decide to create your profile and fill out our questionnaire: your gender, gender identity, ethnicity, age, educational institution you attended, education level, location, interests, values, dating preferences, and photos.
Browsing: When you simply browse through our Platform, we may collect information on your location.
Through Other Users: Other users of the Platform may provide information about you as they use our services, for instance as they interact with you or if they submit a report involving you.

NON-PERSONAL OR AGGREGATE INFORMATION WE MAY COLLECT

We may collect data that is non-personal, anonymous, or pseudonymous, including, but not limited to, time zone you are in, information on how you first heard about us, browser type, Platform usage history, information regarding any URLs visited, number of logins, login times, time/date of login, data showing the effectiveness of promotional campaigns, ordering data, the type of device being used, other information related to surveys and/or offers, and any other information we are legally allowed to collect.

PAYMENT PROCESSING: APPLE PAY AND GOOGLE PAY

Apple Pay: When you use Apple Pay to pay for our services, information necessary to process the payment is shared with us. Your actual card number will not be shared with us.

Google Pay: When you use Apple Pay to pay for our services, information necessary to process the payment is shared with us. Your actual card number will not be shared with us.

PURPOSES FOR WHICH WE USE INFORMATION ABOUT YOU

We only use information about you to support your experience throughout the Platform or to communicate with you about our services. In particular, we collect information about you to:

recognize you as a registered user;
help you connect with other users;
match your profile with other users’;
respond to your inquiries or requests;
provide customer support;
process your subscriptions and payments;
communication with you about our services;
conduct market research;
improve our services and develop new ones;
comply with all applicable laws or if we are required by law or by a court order to do so;
prevent, detect and fight fraud and other illegal or unauthorized activities
analyze non-personal or aggregate information for the sake of Platform improvement; and
transfer information in connection with the sale or merger or change of control of the Company.

BUSINESS TRANSFERS

We may sell, transfer or otherwise share some or all of our assets, including your personal information, in connection with a merger, acquisition, reorganization, bankruptcy, or sale of assets.

WHETHER WE DISCLOSE INFORMATION ABOUT YOU

We do not disclose, sell, distribute, rent, lease or use any of any user’s personal information or pass on any such personal information to third parties, which are not our officers, directors, employees, business partners, affiliates, licensors, contractors, agents, or representatives unless we have your permission or are required by law to do so. Having said that, to provide you with our services and help you make meaningful connections, we will share your information with other users of the Platform. We may also share some types of personal information with service providers and partners who assist us in operating our services.

Moreover, we reserve the right to use and disclose non-personal information and anonymous aggregate statistics for any purpose and to any third party at our sole discretion.

INFORMATION YOU DISCLOSE: PROFILE INFORMATION & CHAT FUNCTION

We recommend and encourage you (and all users of the Platform) to think carefully about the information you disclose about yourself via your profile or chats with others. We also do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, drivers’ license details and other sensitive information which is open to abuse and misuse. When you post information about yourself or use the chat function to communicate with other users of the Platform, the amount of personal information you share is at your own risk. When using the Platform, you should assume that anything you post or submit on the Platform may be publicly-viewable and accessible, both by users and non-users of the Platform.

SHARING FUNCTIONALITY WITHIN PLATFORM

You may choose to share other users’ profiles and they may share yours with people outside of the Platform, using the sharing functionality.

PROFILE VERIFICATION INFORMATION (INCLUDING BIOMETRIC INFORMATION)

For safety and security and to ensure you have the best possible user experience, we may use the facial recognition technology built-in into your own device so that we can compare the photo you submit to your profile photo, to help ensure that you are who you say you are. We do not add verification photos to your profile. We retain the scans so that we can verify you in the future and for our record-keeping purposes until we no longer need them for such purposes or for three years after your last interaction with us, whichever occurs first. After the applicable retention period expires, we take commercially reasonable steps to permanently and securely delete the scans from our systems.

FEEDBACK & REVIEWS

If you submit any feedback or review about the Platform, our services, or subscriptions, by doing so you will automatically transfer to the Company all rights in such feedback and review and agree that the Company will have the right to use such feedback or review and related information in any manner it deems appropriate. We will treat any feedback or review you provide to us as non-confidential and non-proprietary. You agree that you will not submit to us any information or ideas that you consider to be confidential or proprietary.

MINORS (CHILDREN) POLICY: MINIMUM AGE REQUIREMENT

We comply with the strictest laws that protect the privacy rights of minors. Therefore, in order to become a user of the Platform you must be at least 18 years of age or of the age of majority in the state you reside. We do not knowingly collect or solicit personal information from anyone under this minimum age. If you are under the minimum age, please do not send or share any information about yourself to us, or other users of the Platform, including your name, address, telephone number, or email address. In the event that we learn that we have collected personal information from an individual under the minimum age, we will suspend such user’s account as quickly as possible.

HOW LONG WE KEEP YOUR INFORMATION

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements) or up until such time when you withdraw your consent for processing it. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

DATA STORAGE & SECURITY

The security of your information is very important to us. We apply all reasonable security measures and comply with the industry standards to protect your personal information (including, preventing the loss, misuse, unauthorized access, disclosure, alteration, and destruction of your personal information).

We host information about you in secure servers and cloud-based environments provided by Amazon.com, Inc. (“AWS”). AWS takes top security measures in order to ensure safe retention and storage of personal information. Please be aware, however, that despite our efforts, no security measures are impenetrable. No method of transmission over the Internet, or method of electronic storage, is 100% secure. Thus, while we strive to protect your personal information, we cannot ensure and do not warrant the security of any information you transmit to us. You are also responsible for helping us protect the security of your personal information. For instance, never give out your password, and remember to log out of your account after each session.

SERVICE EMAILS & OTHER IMPORTANT COMMUNICATIONS

We will send you only service-related emails and notifications, including notices of any updates to the Platform’s Privacy Policy or other statements or notices of account deletion or suspension.

COOKIES POLICY

The Platform does not use any cookies. A “cookie” is a small piece of data sent along with pages of a website and stored by the user's web browser on the user's computer or mobile device. Cookies were designed to be a reliable mechanism for websites to remember certain information (such as items added in a shopping cart) or to record a user's browsing activity (including clicking particular buttons, logging in, or recording which pages were visited in the past). Cookies are intended to help you access a website faster and more efficiently because they can store information to help you enter a website without having to log in. In effect, cookies tell the website that your browser has been to the website before. It does not need to know your exact identity. Cookies can also be used to remember arbitrary pieces of information that the user previously entered into form fields such as names, addresses, passwords, and credit card numbers.

YOUR RIGHTS AND CHOICES

We want you to be in control of your information, so we want to remind you of the following options and tools available to you:

Access / Update tools in the service. Tools and account settings can help you access, update or remove information that you provided to us and that’s associated with your account directly within the Platform. If you have any questions about those tools and settings, please contact us for help.
Uninstall. You can stop all information collection by the app by uninstalling it using the standard uninstall process for your device. If you are using the website, then you may stop using the website to stop further collection of your information. Remember that by uninstalling the app, your account does NOT get closed.
Account closure. To close your account, please use the corresponding functionality in your account settings.

We also want you to be aware of your privacy rights. Depending on where you live, you may have the right to:

Access/know. You may have the right to request a copy of the information we keep about you, and in certain circumstances to receive this in a portable format. You can exercise your right to access directly within the Platform by contacting us.
Delete/erase. You may request that we delete the personal information we keep about you. You can exercise your right to delete your personal information by contacting us.
Correct/rectify/update. You can correct most information you provided to us by editing your profile directly in the Platform. If you believe the information we hold about you is inaccurate, you may contact us to update it.
Object/restrict. You may also have the right to object to or request that we restrict certain processing. To do so, please contact us directly.

For your protection and the protection of all of our members, we may ask you to provide proof of identity before we can answer the above requests. Keep in mind, we may reject requests, including if we are unable to authenticate you, if the request is unlawful or invalid, or if it may infringe on trade secrets or intellectual property or the privacy or other rights of someone else. If you wish to receive information relating to another Platform user, such as a copy of any messages you received from them through our Platform, the other user will have to contact us to provide their written consent before the information is released. We may also ask them to provide proof of identity before we can answer the request. Also, we may not be able to accommodate certain requests to object to or restrict the processing of personal information, notably where such requests would not allow us to provide our service to you anymore. For instance, we cannot provide our service if we do not have your date of birth and thus cannot ensure that you are 18 years of age or older.
